The Companies Tribunal (the Tribunal) in partnership with the Mandela Institute will host a seminar aimed at promoting a culture of resolving commercial disputes through Alternative Dispute Resolution (ADR).

The use of ADR that is mediation, conciliation and arbitration is gaining momentum world- wide in the resolution of disputes especially within the business environment. This momentum is due to the fact that the business fraternity want to avoid long delays and costs associated with litigation. Since its inception the Tribunal has at no cost provided mediation for disputes relating to company law, where parties chose ADR instead of litigation. The resolution of such disputes has preserved business relationships and assisted parties to reach mutually beneficial resolution of disputes and co-operation.

The seminar is therefore aimed at making stakeholders and members of the public aware of the Tribunal’s ADR mechanism of resolving company disputes. It will also provide advice on how to best protect commercial interests by including ADR clauses in commercial contracts.

The seminar is intended to attract law practitioners, the business fraternity, academics and the legal fraternity. The seminar will take place as follows:
