MINISTER PATEL TO DELIVER KEYNOTE ADDRESS AT THE COMPANIES TRIBUNAL’S TEN-YEAR CELEBRATION

The Minister of Trade, Industry and Competition (the dtic), Mr Ebrahim Patel, will deliver Keynote Address at the Companies Tribunal’s ten-year celebration which will be held as follows:.

One of the most significant improvements introduced by the Companies Act No 71 of 2008, was the establishment of the Companies Tribunal (the Tribunal). It was established to speedily resolve company disputes through adjudication and alternative dispute resolution (mediation, conciliation, and arbitration). This meant that companies and ordinary citizens have better access to justice where they can resolve company related disputes speedily and free of charge. The Tribunal was therefore established as an alternative to a court system, where disputes can be informally and without the need for legal representation resolved. Over the years, the Tribunal has grown from strength to strength to become a recognizable organisation in the sphere of company law.

 
Over the past ten years, majority of cases received are name disputes (Section 160), followed by directorship disputes (section 71(8), social and ethics committee exemption (section 72), extension of time for holding AGMs (Section 61) and CIPC reviews (section 172(1)).  Majority of the applications received were filed by law firms and company secretarial services, while the rest were files by natural persons. Very few decisions were taken for review at the High Court as the Act prescribes.

 
The celebration will be an opportunity to reflect and acknowledge our achievements, challenges and thank our stakeholders for their support. The Tribunal’s Chairperson, Judge Dennis Davis, will also deliver a speech.
