Seminar on the impact of the Companies Tribunal’s mandate

The Companies Tribunal (the Tribunal), in partnership with the University of Cape Town’s (UCT) Commercial Law Department, hosted a seminar relating to the Tribunal’s mandate.

 

The seminar focused on the role of the Tribunal in four types of applications provided for under the Act:

  • Social and Ethics Committee exemptions in terms of section 72;
  • Name Disputes in terms of sections 11 and 160;
  • Alternative Dispute Resolution in terms of section 166; and
  • Directorship Disputes in terms of section 71.

For each topic or session, the audience heard about internal view from the Tribunal and external view of representatives from companies, academia and law firms.

 

The sessions provided the audience with a good view of interalia:

  • The role of the Tribunal and its impact thereof;
  • The areas of difficulty in adjudication and resolution of disputes; and
  • Possible solutions to the identified challenges.
