The Companies Tribunal in partnership with UKZN’s school of law, hosted a seminar on: The importance of alternative dispute resolution (ADR) envisaged by section 166 of the Companies Act no 71 of 2008.

The seminar aimed at making stakeholders and members of the public aware of the Tribunal’s ADR mechanism of resolving company disputes.
Alternative Dispute Resolution (ADR) is a welcomed active solution-seeking consultation process aimed at furthering the right to access to justice of parties involved in civil matters. The Seminar created a platform for discussion on Alternative Dispute Resolution and Access to Justice in the 21st Century and how the Companies Tribunal’s ADR mechanism can deliver justice to companies as contemplated in the Companies Act. The seminar also delved into the Jurisdictional perspective of ADR and access to justice, the role of the legal profession in promotion of the ADR as well as the various types of disputes experienced by the business sector and the manner in which these disputes may be resolved.
