This is an application in terms of section 160 of the Companies Act 71 of 2008 (the Act). The Applicant request an order directing the Respondent to change its close corporation name by removing the Applicant’s trademark there from. The Applicant’s trade mark is ‘SOUL FOOD’ and the Respondent’s close corporation name is THA’PHE’ SOUL FOOD.
