The applicant brought this application on the basis of an interest it has in the registered trade mark SKYE, belonging to another entity called LA Group Limited. The applicant’s interest in the trade mark is said to arise from the
appointment of the applicant as a manager of the licensing of the SKYE brand and a licensed user of the SKYE trade mark. No proof of both averments is included in the papers before this Tribunal and thus the standing of the applicant to apply for the remedy sought is on rather precarious grounds.
