The Applicant brings an application in terms of section 11(2) and 160 of the Companies Act 71 of 2008 (the ‘Companies Act’) for an order that the Respondent change its name as it incorporates a trade mark that is registered in the name of the Applicant and is well-known (para 3.2 supporting affidavit).
