The Respondent is the COMMISSIONER OF COMPANIES appointed in terms of section 189 of the Companies Act No 71 of 2008 (“the Act”). The Respondent is cited in its official capacity as the entity responsible for the function of the Commission of Companies, including but not limited to, the reservation of company names and the registration of companies in terms of the Act.
