This is an opposed application brought in terms of section 160 of the Companies Act 71 of 2008 (“the Act”), in which the Applicant seeks a determination that the First Respondent (“Respondent”)’s registered name, “APS SADC (Pty) Ltd”, does not satisfy the requirements of section 11(2) of the Act, together with consequential relief directing the Respondent to amend its name so as to remove the element “APS”, failing which the Companies and Intellectual Property Commission (“the CIPC”) is to substitute the Respondent’s registration number for its name.
