The applicant complains in terms of this application that the second respondent’s name, “BUSINESS GROWTH POINT” or part thereof, when considered against its registered trade marks, the applicant’s name and the applicant’s other registered company names, is confusingly similar and/or falsely implies or suggests or is such as would reasonably mislead a person to believe incorrectly that the second respondent is part of or associated with the applicant.
