The Applicant seeks an order for the removal of the Respondent as a director of “Constant Flow Electrical (PTY) LTD”. Applicant alleges amongst others that; respondent has suffered from mental ill-health for some time and is such that he is “incapacitated”; the respondent has lost interest in the company and effectively abandoned his position as a director of the company and performs none of the tasks which are ordinarily associated with being a director; respondent made transfer’ of funds from the company’s bank accounts, with no established proof of the claim. This application is opposed.
