The applicant is a proprietor of the trade mark “FLEX PAY”. In this application the applicant objects to the respondent’s name or the inclusion of the word or words “FLEXPAY” in the respondent’s name. The applicant claims that the respondent’s name is inconsistent with the provisions of the Companies Act 71 of 2008 (the Companies Act) in respect of its trade mark. The respondent ought to be directed to change its name to one satisfying the requirements of the Companies Act.
