The Applicants object to the First Respondent’s use of its name, and seek an order that the words “Twisted Whiskers” be removed from the First Respondent’s name on the basis that it contravenes section 11 of the Act – particularly on the basis that it is confusingly similar to the names of the Applicants. Neither of the Respondents having opposed the application, the Applicants now seek a default order.
