The Applicant issued and filed a notice of motion in compliance with form CTR142 in terms of Section 180 to 184 of the Companies Act, 2008 and Regulation 145(3) of the Companies Regulations 2011 against the First Respondent, wherein the Applicant requested the Companies Tribunal to grant it the following relief by judgment:
- Directing the First Respondent to change its name to one which does not incorporate the trademark FASA or any other trademark/word that is confusingly and/or deceptively similar to it.
