This is an application in terms of Section 71( 8) (b) for the removal of a director of the company FCMS(the Company), for the reason as envisioned in Section 71 (3)(b) of the Companies Act 71 of 2008 (the Act) on the alleged basis that the respondent has neglected and/or been derelict in the performance of the functions of the Director of the company including of various acts of a potentially criminal
nature against the shareholders of the company and the company itself.
