The Applicant seeks the removal of the Respondent as a director of the Company in terms of s 71(8) of the Companies Act 71 of 2008 (“the Act”), alleging that the Respondent has been neglectful or derelict in the performance of her duties as a director, as per s 71(3)(b) of the Act.1 He contends that, as a consequence thereof, the Respondent is disrupting the proper business operations of the Company.
