The Applicant specifically highlighted concerns regarding various complaints it was receiving from the First Respondent’s customers, who it alleges were mistakenly confusing the Applicant for the First Respondent. The Applicant further alleged that the First Respondent was infringing on its registered trade mark and requested the First Respondent to refrain from, inter alia, using the name Hi-Tech and/or Hi-Tech Solar.
