On 30 January 2023, a member of this Tribunal, Mr Brain Jennings, dismissed the Applicant’s application on the same facts that this Tribunal is again requested to adjudicate. In his decision, Mr Jennings pointed out, among other things, that:

• The applicant failed to follow the proper administrative procedure in his application for a default decision.
• The Applicant failed to satisfy the Tribunal that the appropriate case has been made to find in his favour.
