In this application, Imperio Proprietary Limited (the applicant) objects to the use of the company name “Imperio”, by the respondent private company, which, evidently, bears the same name as the applicant: “Imperio”. The applicant complains that the respondent’s name denotes association and/or affiliation between the applicant or its business and the respondent, which is impermissible in terms of the provisions of section 11(2)(c)(i)1 of the Companies Act 71 2008 (the Companies Act).
