Applicant requests the Tribunal to make a finding that the Respondent’s name does not satisfy the provisions of section 11(2) of the Act. It submits that the inclusion of the word JOEST in the Respondent’s name infringes its trademarks, “JÔST” and “JOEST” (the latter being the English spelling of the former German name).
