The applicant and respondent are the only directors of a company known as Divine Asset Management Proprietary Limited (the company). The applicant seeks, in terms of this application, the removal of the respondent as director of the company. This type of application is what is contemplated by section 71(8) of the Companies Act 71 of 2008 (the Companies Act).
