The applicant applies in terms of section 160 of the Companies Act 71 of 2008 (“Act” / “Companies Act”) and regulations 143 and 153 of the Companies Act (GNR 351 of 265 April 2011) (“Companies Act regulations” /“regulations”) for a default order that the respondent be ordered to change its name, to wit “Hallmark Institute (Pty) Ltd” because it does not comply with section 11 of the Companies Act.
