The Applicant brings an application in terms of Sections 11 (2) (b) and (c); and Section 160 of the Companies Act 71 of 2008 (the Act”) for an order that the Respondent change its name as it “incorporates a trade mark that is registered in the name of the Applicant and is well known”.
