The Applicant and Respondent are entities registered in terms of the Companies Act (Act) and the Close Corporations Act respectively, both having their principal place of business in Durban, Republic of South Africa. The Applicant requests that it be permitted to retain the name registered by CIPC, whilst the Respondent stated in its answering affidavit that the application was defective; and that the Tribunal has no jurisdiction.
