This is an application for the review and setting aside of an administrative decision taken by the Companies and Intellectual Property Commission(the CIPC), in terms of which it refused to reserve the proposed name applied for by the applicant. The matter to be determined is whether the refusal is lawful or not. The application is launched in terms of Section 160 of the Companies Act 71 of 2008(the Act) read with Regulation 13(b) of the Act.
