The applicant conducts business in the hairdressing and related services in Benoni. The respondent conducts a similar business, about 50 kilometres away, in Alberton. The applicant was registered in September 2006, whilst the respondent was registered in January 2018. The former objects to the latter’s name on the ground that the latter’s name includes the words “Moulin Rouge” and, therefore, does not satisfy the requirements of the Companies Act 71 of 2008 (the Companies Act).
