The applicant seeks exemption from appointing a SEC on two alternative fronts. Firstly, on the basis that bearing in mind the nature and extent of its activities it is not reasonably necessary in the public interest for the applicant to appoint a SEC.8 Secondly or alternatively, that “the [a]pplicant already substantially performs the function of a Social and Ethics committee by complying with other legislation and contractual requirements”.
